END USER LICENSE AGREEMENT (EULA)

Neuro Innovations Add-on Multimedia Library

For the purposes of this agreement "multimedia resources" includes all image, audio and video files that are part of the "Neuro Innovations Add-on Multimedia Library". Terms that apply to an entire file apply equally to a part of a file in the case of editing.

REDISTRIBUTION OR COPYING OR RESALE IS NOT PERMITTED

"Redistribution not permitted" means that you may not pass any of the image, audio or video files to a third party for any reason or by any means. This includes using our multimedia files on any web-site in part or in full and includes using our multimedia files in part or full within documents or presentations.

"Copying is not permitted" means that you may not make a copy of any of the resources by any means including by copying files, filming or photographing displayed images / videos, or by re-recording played audio. Public presentation of any of the media resources is also not permitted apart from as part of therapy with a client or patient without the presence of an audience. Clearly the process of installing the resources onto your hard-drive for use within Neuro Innovations products is permitted.

"Resale is not permitted" means that you may not sell or repackage the multimedia resources to others in any way.

USE ONLY WITHIN NEURO INNOVATIONS PRODUCTS

The multimedia files can only be used within products directly developed by Neuro Innovations. This excludes use in part or full of any of our multimedia files within any other psychotherapeutic software product. This also excludes the integration of any of our multimedia files into any other software application.

Use by therapists with a client using direct display software such as "View as slideshow" within Windows is a permitted exception.

EXEMPTION ONLY WITH PERMISSION

If you have our permission to do so in writing then you can distribute to others eg as part of a document. Our permission is however required and there may be a small fee involved depending on the intended use and audience.

EULA TERMS MAY BE CHANGED WITHOUT NOTICE

This means that we reserve the right to change this agreement if we find that abuses have taken place.

TERMINATION

This License Agreement shall terminate automatically if you fail to comply with the limitations described in this license. No notice shall be required from Neuro Innovations to effectuate such termination. Upon termination, you must destroy all copies of the Software and Documentation.

DISCLAIMER OF WARRANTY

THE MULTIMEDIA AND DOCUMENTATION ARE PROVIDED AS IS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEURO INOVATIONS FURTHER DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. THE ENTIRE RISK ARISING OUT OF THE USE OR PERFORMANCE OF THE MULTIMEDIA AND DOCUMENTATION REMAINS WITH YOU. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NEURO INOVATIONS BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, DIRECT, INDIRECT, SPECIAL, PUNITIVE, OR OTHER DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THIS AGREEMENT OR THE USE OF OR INABILITY TO USE THE MULTIMEDIA, EVEN IF NEURO INOVATIONS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
